I think when you are 35+ and 'you are in the 7th/8th/9th year of H1b with no idea if/when you will get GC' it's practical to invest in business.
While we are at it let me throw this in....
Assuming you decide to persue MBA from a good university instead of online. What kind of investment of time and money are you looking at? Is it really worth the investment when you are already in your 30's? Is is worth spending the time and money on a MBA? If you spend the same time/money on a business opportunity wouldn't that be better in the longer run? Is it practical to start a business when you are in the 7th/8th/9th year of H1b with no idea if/when you will get GC? Is it a safer bet to invest in education?

They are trying to make sure that current situation is better. The message is clear.If you ask more you will lose whatever yo have also.

Spoke to a lady named Rebecca, she sounded like she was not happy that she is receiving many calls from IV members. She was trying to tell me that she has received the message and will pass it on to Rep, but further calls are not going to help.
Once I asked her "Are you suggesting that we (IV members) should not be calling your office regarding this important bills", she toned down a bit and took my message.

Question for people who understand Washington better than me�.
Do we really have to ask for the person who handles legislative and immigration matters or it is ok to leave message to the person who answers the phone? I guess the answer is �it�s better to talk to the person who handles immigration matters�, but as per my observation, immigration person in representative�s office deals with any immigration issues related to constituents.

Dude, You might be a new entry in to the ball of Immigration now. As said earlier , every one is free to judge and post the queries. If IV is shutting door of any questions you wouldnt have seen forum threads. There is enough discussion and direction taken on information being released to ALL members. Why one should complain IV not doing anything ?

here are some atleast, immaterial you agree or not:

1. If ppl are reaping benefits of EAD for multiple years , its becoz of IV.
2. whole of July fiasco was a win becoz of IV , not sure whether you are in the boat, but i can see the pain and how IV helped all of us.
3. all the admin fixes were co-ordinated by IV ,
4. The list goes on.. those 3 above are just enough to prove the help an ORGANIZATION did with minimal resources. Also please note none of the core are full time IV , they are also ppl like you and me.

Reason one has donor forum is becoz they are trusted sources. How can one know that you are pro-immigrant or anti-immigrant.

You would see dialy or minutes updates on sites of anti-immigrants becoz they have dedicated members and number base is too high.

Again , no one is shutting door against you, looking at your post i see you are shutting door against yourself just becoz your idea of Fax through AILA is not acceptable as an IV agenda.

Do you know first of all what provisions in CIR 2007 were in there which would have broke the back of ppl on H1 and potential immigrants? Can you confirm which provisions of CIR 2009 if there be one will help you ? will you support CIR even if it says you have to go back to india in no time ? AILA never mentioned in first place whether it would support EB community.

Plain simple, we pay Dollars even to newspaper ... You dont want to contribute for your own cause but get info for free and prove that will raise for your own cause. Those newsletters are for your benefit and collectively for the whole community.

Still IV is posting info to non-paying members , IV Never shuts its door but with limited resources they are doing what they can. Before complaining on IV you do your part. :cool:

Also , FYI... AILA doesnt post all messages to free members .. all the critical info is circulated via PAID members of AILA.. this is part of any organization ... Can you complain against AILA, becoz if you are FREE member of AILA you still get emails like the one reg. Fax to CIR... There is a lot going in background for CIR than many of us even know...


Paskal, You are right - I do not understand. But mostly I cannot understand because as an organisation - you do not explain. Frankly, all I can do is register my disappointment at both your response and your attitude.While I get it that IV is actively involved in doing things over the years aimed at resolving this issue, I might feel that I could respect and maybe even understand these efforts better if IV kept its website up to date and all members who sign in updated on what's happening.

I have often seen threads on this site that have members complaining that IV is not doing anything - to which invariably the response is that one should join the donor forum. On the other hand we get newsletters from admin that ask up to tighten our belts etc. - and get more involved. Well, that cannot happen unless IV provides more updated information on what IV is actually doing, veiled references to behind the scenes activity and years of hard work are not enough to involve all those who have signed up here to become 'more involved'.

As for this discussion going nowhere I could not agree more - you see to have an open discussion or indeed debate - there must be at least 2 willing participants. And since you have already decided that you do not have time for the Qs of a mere non-paying member of this forum, I do not expect any better.

By the way, the way ahead is not to close doors, but to welcome questions and encourge those on this forum with curiosity to be more active. More often than not, I have seen that those who Q on this forum, are mocked, ignored, and treated as if they are wasting CORE's time. Sad for a forum that hopes to involve a wider audience in this issue.

I am not condoning what 'mirage' said to you or any such irresponsible behavior on the forum BUT your complaints to the moderators would have carried more weight if you were behaving in a modest and civil way yourself. Of late, you leave no stone unturned to write flaming messages to piss off others on this forum. There is a rumor going around now. One of my colleagues here claims that he got a call from his attorney that there is going to be a new bulletin for july, released either tomorrow or on Monday. Can someone talk to their attorney and confirm this?

I'm unable to reach my attorney now.

Rumors seem to be getting stronger by the hour. And all the info is coming from lawyers who are usually conservative in releasing such information.

Don't get your hopes up... just wait and watch. Never worry about anything that's not in your control! That's the way to living nirvana...

The ideas to make this forum a paid one is going to be a big disaster. Please excuse me for being blunt about it. Everyone who is suggesting paid membership should remember that most of them are here for information, they will go elsewhere if they have to pay for reading and writiing posts on this forum. Remember the crowd here are internet users who use it for obtaining legal second opinion and also for cheap bargain shopping. They would always find another place to gather and discuss their thoughts and opinions.
I would say Ads are a better way to generate revenue, but I don't know the income reporting requirments. There can't be any secrets about financials if you are taking donations. The audited information can be obtained by any interested party if they are a paid member.

Please don't mistake me for a anti. I am a person who would be interested in seeing the goals of this organisation succed. That is the reason I am pointing out what could go wrong with the paid membership plan.

PS: Paid reputation service is welcome as far as the revenue generated is shared by IV and the person who gets a reputation. This would motivate the people to focus and also reap the rewards in cash. Postive reputation would be $1 and negative reputation would be $5. The sharing would be 70% for IV and 30% for the member who received the reputation. The higher fees for negative reputation would help the members from staying out of dissing other members and making this place were people fight with each other.

You are right, we don't have an open enough mind to accept that Santa exists.

A recent U.S. Department of State (DOS) directive to U.S. consular posts now requires consulting an electronic record for visa issuance in nonimmigrant categories H, L, O, P, and Q. This was first reported to MurthyDotCom and MurthyBulletin readers in our December 7, 2007 article, PIMS Verification Required for Certain Nonimmigrant Visas. The verification of visa petition approvals is now carried out through the Petition Information Management Service, known as PIMS, even if a beneficiary takes an original I-797 approval notice to the interview. The American Immigration Lawyers Association (AILA) asked the DOS to clarify the purpose and the functioning of this directive. In response, the DOS provided this important information to AILA members.

The new verification system requires that the U.S. Citizenship and Immigration Services (USCIS) send information on all approved petitions requiring visa issuance to the Kentucky Consular Center (KCC), which is part of the DOS. KCC scans and enters all pertinent information including Form I-129, employer support letter, and beneficiary's identification documents into PIMS. KCC also conducts database checks looking for fraud, violations, or other adverse history and records. A petition must be confirmed in PIMS by the U.S. consular post before issuance of the visa. The USCIS has not been transmitting petitions filed for change of status and extension of status to the KCC. Neither have all new petitions for consular processing been transmitted to KCC, resulting in delayed visa issuance to eligible applicants.

The DOS has indicated that most of the cases approved for visa processing are being entered into PIMS in a matter of hours. As a result of the new directive requiring multiple checks for fraud and other adverse information, the DOS is able to find forged and altered I-797 approval notices for companies that no longer exist or that never existed. In addition, if a visa applicant has neither an original nor copy of an approval notice and the information has been entered into PIMS, no such notice is required for visa issuance. While some posts still require original approval notices, the DOS is developing clear guidelines to eliminate this requirement.

Do you know if these are 485 or 140 applications? Would be nice to know these numbers by PD and how it compares to pending applications for ROW.

I am a July filer and was issued a RFE recently. The last update on my case happened a week after USCIS received my reply. I have not been notified for any fingerprinting.

Thanks everyone for the feedback. Can some guru put this issue to rest? I guess the only question that remains is:

"For a person who has extended his H1 beyond the 6 year category on the basis of AOS, would this H1 extension be valid if I-485 is denied (either wrongly due to AC21 or otherwise)"

Anybody has this situation?

My case was sent by my attorney June 29th (current July bulletin) USPS certified mail.

As per USPS online tracking record it was delivered July 2nd 12.45 PM.



No receipt yet. So far sounds okay.



But I got the copy of actual delivery receipt stamped by F.Heinauer (Director NSC USCIS) with the date 062907.

It is a stamp so some of their employee clearly has stamped it.



Now I am confused if that’s the receipt date they are going to go with and may reject the application.

And with this many application it may take more than AUG 17th to receive anything back.



I am very sure it was reached on July 2nd. It was only sent June 29th afternoon.

And USPS is telling there is no delivery can reach so fast. According to USPS the guy who might have stamped the delivery did not changed the stamp date from 0629 to 0702 since it was a weekend.



Anybody in the same situation? Any advice?

To my best knowledge only thing that counts is date of delivery : For all July bulletin , the receipt delivery date shud be July 2 + , i believe anything received before this date will be considered cases whose dates are not current.
