I had my interview on 22nd Jan at chennai. Counsulate approved my visa and collected my passport . They did not return my passport for 8 days. On enquiry I found passport was under PIMS verification

On ninth day, I got the passport back along with 221g blue form, asking me to submit through dropbox original 797 AND 156-157 forms.

Anyone else has similar experience? How long woule it take after the submission to get my case processed.

I am confused and frustrated after reading al PIMS related delays

Got Green cards and Welcome notices for me and my wife .
Surprisingly no uscis e-mail and online status is still "initial review"

Our journey in short :

How long in US : 10+ years

First Labor in 2002 . Changed job in three years before approval of labor
Second Labor in 2004 . Approved in 2007
Filed I140 and 485 - in July 2007

Since then I was enjoying EAD / AP with no complain .

I donate to IV now and then , but for some reason only once (for few days) got access to IV-Donor Forum . But always had a faith that IV is doing good work .
From non-donor IV forums and other forums I noticed that USCIS are transferring leftover Visas to other EB categories . I waited to see some thing coming to EB3 but ......nothing came .
My Lawyer told me that I can port to EB2 and it is a normal a process.

1. New Perm
Filed in Feb and approved in 10 days ( Prep work takes 3 to 4 months before filing )

2. EB2 I140 (TSC)
a. Filed in March - Premium Processing
b. My Lawyer sent interfiling letter along with I140 filing
c. Approved in 7 days (A# and Priority Date retained)
d. Same week got Green Cards and Welcome Notices:) - Super-fast Approval
e. No email and no updates on USCIS website

Not sure about the USCIS and Lawyer fees . My company paid for every thing.
Hope every one get the desired freedom asap and don't have to wait like me for 10+ years

ICICI has some very good interest rates. I like them because they have online access to your account which most of the indian banks don't.

ICICI bank will cheat and steal your money. Beware. Also they are exposed to this financial crisis and the news is not coming out. I heard that so many people withdrawing money from this bank.

Q-1 (07//19/2007): I filed I-485 application on July 2, 2007, but have yet to receive either rejection or receipt notice. Will this application be fee'd in under the reversal of the USCIS decision?

A-1: The DOS withdrew any changes to the original July VB and assumedly visa number is current in July 2007 for any categories other than "other worker." Accordingly, the 485 application which you submitted on July 2 cannot be rejected by the USCIS at this point. The USCIS is likely to fee in your application and soon issue the Receipt Notice.

USCIS doesn't write the law they just follows the law. Excluding depends needs legislative fix. IV has been representing the "Exclude dependents" theme but it is not finding much traction with the lawmakers. Currently what is consensus among lawmakers are part of the 3 Lofgren bills. Let us call our House representative and CHC members and ask them to support the 3 bills.

Everyone especially EB3 will benefit if the bills are passed.


I think this is a valid point. We should request from USCIS to treat the employment base category same as other category. I am not sure that USCIS could fix this by themselves or they need any legislation.

This will be a big relief for us and will fix our 50% backlog.

If you sit with ten people you know, and talk about these issues, and resolve to do something about the situation, and come up with an action plan and an operating mechanism, that will be where the strength of IV lies.

This forum provides good live information (when there is a senate testimony, or call Senator session's office campaign going on), and sometimes useful information and announcements.

But most of the time, you will get opinions, and comic relief from here.

Friend of mine (to whom I contacted regarding IV) is in USA for 7 years and knows how lobbying & party funds are raised (including Watergate) and also very much aware of "Retrogression" and problems of being "Legal".

Also, he is aware of cause of IV and appreciate that but he is un-comfortable because whenever he login to IV, he noticed that:
- more than 40-50% respondents are talking about money/contributions & signatures showing how much they have contributed as of today,
- 10-15% are talking about blocking non-contributors(calling by Free Lunchers etc..),
- 5 % are Pseudo intellectuals (talking BIG but dont know immigration basics like - PD, issues of I-140/I485)
- 5% are always trying to shutdown others, accusing/calling by names to other forum members (he says "Highly skilled" in accusing!!)
- and remaining are "Positive" contributors for IVs retrogression cause (talking about - I spoke to senators office, can we arrange rallies, when to Fax/fliers, when State chapters are going to meet, posting excerpts from senate/CSPAN/News etc..)

Is our audience is so? Can we focus on our cause? pl be together like.. Like-Minded!!!

I think one very serious point in favor of filing now is if you do not file, and the lawsuit is successful in about a year and a half as they say and your PD hasn't become current by then, it puts everyone who filed in July ahead of you and this might cause the USCIS to retrogress visa numbers to such an extent that it would take ten years for your PD to get current again. Would this be a correct assessment?

Where did you get the information that it would take a year and half. Is it just a guess!!!

Thank you. Please encourage everyone to sign too. H1 visas have a fee to retrain, educate students in math and science. It amounts to billions of dollars that is used for educating students here. I think we need to educate him and not put up with whatever he feels can say and untrue. Besides we have all contributed and have not strained any support system like social security, medicare.

desi companies sell H1b also , u pay money and they will get it for u , see sulekha.com for example .
no wonder ieee-usa complains about the present h1b program.

Couldn't disagree more with kaisersose or guns. GC system as it exists is rubbish and ugly in many ways- but as bad as it is that's what's legal and in place now so we have to go thru that and if possible, make it better along the way appealing to the saner elements of the society. Brain drain is tricky - you guys are honest enough to admit to not having it so theres clearly no drain there but other programmers will disagree. Some history lesson's also in order - will do it later. But that's why america needs me - i'm an annoying reminder to its core value(related to immigration) when a section forgets it or finds it inconvenient or abhorrent- and if i were to shed some modesty-and i'm going to-, i'd grandly say i'm here to remind some countrymen about what it means to quintessentially be an American

Congrats Man, all the best for your future, I have yet to apply for GC (i am in my 4th year of H1 B, my company said they would take care of it, and they are painfully slow, i have now been here for 7+ yrs).
Immigration is personal choice in my opinion, i am sure it makes sense to say i am proud of my heritage/culture, but like everybody else i came here for a better life.
The wait for GC is very very frustrating, other the other hand it is absolutely unnecessary if the Immigration authorities just put a little effort and time into resolving it, I guess that is a underlying statement about skilled Immigrants, you have to go through a lot of frustration, pain, and anxiety to be worthy of a GC. I am beginning to wonder, if all the energy (positive and negative) i am spending here to get my GC could be spent more efficiently and in a calculated manner in India (:confused:)
I am from India, I hate corruption and bureaucracy prevalent out there, I came here for a life filled with fun and freedom(what i thought was a better life :(), i still would like to have GC, but the wait, the tension that i need to take out here, is pushing me back to thinking maybe coming here was not a good choice in the first place, my Family is in India, and a couple of my friends are still around in India , so hopefully, when i DO go back i can hang around them and have FUN.

As one of the members said, you cannot take India out of a man, why ?, because we have 5000+ yrs of glorious documented history, a wonderful ,colorful culture, and is the home of great people, that's why !, and that culture is entrenched in our psyche. The generation of kids born to indians here is US wont/cannot/ relate to that psyche, people like us export India, but for the next generation India ceases to exist, just my 1 cent.

This is pure speculation on my part, but if CIS is returning visa numbers and there are now some visas available, it seems like it would make more sense for DOS to just make the returned visas available in the August bulletin, rather than flip flop on July once again.

I agree with most of things you said. By the way, I called the office of the Honorable Attorney General Alberto Gonzales today. I sent e-mail messages as well. Obviously I don't even ask about fixes since he is not supposed to have that power. However, I requested a timeline on when the EB3 I-485 cut-off dates are supposed to move ahead. That is something he does have power to do.

Regarding your conclusion on our local IT professionals, I am not sure if that's always the case. I hope you are right.

I agree that it is very important to clear what is "rihgt", "privilege" and "symphaty". I tried to do that several times before and in order to avoid any misunderstanding have quoted below a part of one of my messages. Please read it carefully.

"I do believe that I HAVE THE RIGHT to get my LCA adjudicated in 2-3 months time (OK, make it 6 months, having in mind you are dealing with an inefficient administration).
I do believe that I HAVE THE RIGHT to know in short term (2-3 months, not 3-4 years !) if I am eligible for permanent residency.
I do believe that I HAVE THE RIGHT to know how long (if approved) will take the I-485 process.

These are clear, simple questions that require clear, simple answers. Getting these answers (NO is also an answer) in a reasonable period of time is a right, not a privilege..."

Americans have the right to determine how many immigrants they need and how to handle this issue. But we have the right to follow clear and simple rules for that process. It seems to me that the way they currently handle the H1 immigrants has a lot to do with the "Las Vegas" type of business (gambling) - shall I get my LC approved, when will I get the LC approved, shall I get a GC, when can I get the GC etc. The rules change permanently and half a million hard working people are in limbo for a decade and more. That is not fair and this is what you have to explain to the Americans.

And, btw, if the local IT "professionals" you were debating with were so great, they would not be unemployed...
