You have a valid point about gctest. But again, there is no way EB2/EB3 gets to port to EB1. If it was so, then it would be a chaos here. Only porting that happens is E3 to EB2 and may be that's why he used EB3 in his post.

Incorrect. PD recapture (aka porting) is allowed between EB1, EB2, and EB3 preference categories.

Here is my case trail

worked with employer A from June 2005 on h1b visa.
Employer A applied for GC under PERM EB2 with PD - March, 2nd 2006 - labor approved in a couple of weeks
Employer A applied for i 140 in June 2006 and got approved in July 2006
Filed for i 485 in July 2008 never received FP notices
Project got over in last week of February 2008 and unable to find new project.
I switched jobs in last week of April 2008 using EAD - using AC21
Sent AC21 letter to USCIS in July 2008 about job change.
Employer A requested 140 revoke in August 2008.
Spouse got FP notice in August 2008 whereas I (primary) got NOID asking for new employment details.
Responded to NOID in a timely manner and on August 25th, 2008 - my status changed to "Response received - case processing resumed"
In Jan 2009 I got my FP notice.
In Jan 2009 - I travelled using AP and got back fine.
In March 2009 - I got a denial notice saying "485 is denied because 140 was revoked on August 2008. No appeal only MTR" - thisletter comes from a different officer id than the one who sent the NOID.

My question to UN and other gurus. Does it have anything to do with a changed interpretation? My lawyer says "This is a training issue - the new officer did not know about AC21 and as soon as he/she saw 140 as revoked - just ignored your other details on the case and issued a denial notice. This is very common and can be resolved using MTR"

Your lawyer is probably correct. This has to do with IO who are not aware of AC21 laws. But make sure your employer did not have any issues with DOL, USCIS in responding to RFEs related to other employees like H1 RFE, ability to pay , etc which may be used against your application.

I got a RFE for Ability to pay for My I140(EB-3, PD-Ap2003) from USCIS. After consultation I was suggested that I needed an expert opinion letter from an Independent CPA telling that company can pay me the salary stated in the ALC. Now I need a CPA who can analyze the financials of the company and a lawyer who can write the letter to defend this case. I was wondering if anyone here can provide the service for CPA analyzation or sample letter on how to address this issue.

I have an MS degree, so IF the SKIL is passed, my PD will become current. However, I guess the earliest time for SKIL to be passed is Oct, if it is ever passed.

Does the SKIL bill apply only to MS, or MBA too ?

I am sure he had to struggle to get his GC first as we all did and then wait to become a US citizen.

Looking at the wait times for current applicants, my wait time was nothing.

I hope things improve for better. There is no reason why one has wait for 5+ years to become permanent resident.

Exactly my thoughts. However, that does not mean that I am not proud of heritage and culture of my country-of-origin.

The vast majority of people are here on these forums for getting their GC and USC.

I appreciate everyone who has congratulated me. Thank you so much. Please note that I sill belong to legal immigrant community and nothing can change that.

Anyway, I am still confused. If I am proud of my country of origin and its heritage then it must be absolutely impossible for me to entirely renounce and abjure all allegiance and fidelity with my country of origin. That is the expectation every human society or country generally have and must have to advance its own culture. Well I can not see myself fitting in that "Ethics watch" if I am changiing citizenship. If I am changing citizenship I absolutely do not have strong ethical connection with my heritage and country. And in that case it is fine to change citizenship for me and if I do that I would not speak about pride to my heritage and country. And if I am really and sincerely proud of my country of origin I would not become citizen of other country in spite of any attractive lure. It is that simple.

If any employer is minting too much and troubling a lot, make all necessary advances that one can physically produce, in such case once the person is approved with good status of Green Card one can sue the employer, that would be the right time to bring him to justice.

My lawyer put in a SR on Sept 1. On Sept 11 i recd. the email saying that i was approved. My situation was similar to yours. Same company for 8 years, no RFE - infact no updates on my online status since Sept 2007 when it was first updated to reflect the fact that the application was recd at NSC. So i am assuming that SR triggered review of the application but with USCIS who knows.

Hopefully you will get your approval soon if my case is any indicator (admitted the sample size = 1)

I have now 2 SRs one was opened on 9/4 (for myself - primary applicant) and one on 9/11 my wife - she got reply today like 1 working day after - which is surprising - that " her case is with the officer and getting reviewed - I guess the standard reply.

what makes you think i have a website and I evaluate?? Moron, I was asking the person to get the documents evaluated and let other know, so that others who are in same position can benefit from that.

Is this a legal option for a non profit? If so, I suggest we go for it!

Here is one scheme I have been thinking about:
1. Every week members donate any amount they like over paypal
2. At the end of the week one of them is selected and refunded 2 times his contribution amount
3. To make things interesting and ensure the scheme "helps" and not "hurts" IV: Change the selection process every once in a while e.g. One week you select the user who has donated an "average" amount, but next week you select the "highest" donor, in the 3rd week you select the "5th" name in the donor's list irrespective of his amount, and so on.

e.g.
consider the following players/amounts in a given week:
user1: $20
user2: $100
user3: $10
user4: $45
user5: $25
user6: $50
user7: $25
user8: $5
user9: $10
user10: $100
________
Total: $390
Divide by 10 users: $39
This week's selection process: Select the "average" donor.
Who donated an amount closest to the average? : user4 ($45)
Therefore, refund user4 for $90

What IV received in the process: $390- $90 = $300

The other BIG question is: what incentive do people then have to sign up for monthly contributions, which is clearly the preferred way of contributing as it helps in planning and budgeting? The answer would probably be "bigger" prizes for those who sign up for monthly contributions!

Of course... if only people realize there can be no greater incentive than receiving your Green Card sooner/ being able to apply for AOS any time after LC/PERM stage is cleared.... we would not have to care about all these fancy ideas!

Too bad people can't see what is "2+2" until it is shown as 2*2*2 - 2^2!

Considering that we have all spent enough time stuck in the same job for several years it makes sense to prepare for the time if/when we actually get green card.

So I was wondering if anyone here has weighed and compared the cost and benefit of PMP vs MBA. Any thoughts would be helpful.

PMP can take you to Project Management, and with experience higher up in the sr management.
With MBA from a good school you can start at serious management level.
It doesn't have to be vs, you can do both.

If the older core members who have received their GCs are indeed enjoying the fruits of their hard work, God bless them and there is absolutely nothing wrong with that. My intent was never to start a hot debate. God knows we have tons of drama on the forums daily!! ;). (Soon the April VB will be released and more drama)
