Since we submitted the RFE response, there has been LUDs on daily basis since April 23.

LUDs on , 4/23, 4/24, 4/27, 4/28.

Anything to worry?

I went for the visa stamping in chennai consulate on Dec 5th. After a few questions, the officer granted me the visa and said i will receive the passport in a few days. But so far haven't yet received my passport. Does anyone know what is happening? is anyone faced such situation before? I heard about this admin processing and delays in stamping but i thot the officer would usually give out some kind of form to you during the interview if your case goes thru such processing.

The web-site says we can send an e-mail to the consulate regarding any questions for NIV if it's pending more than 5 days. Has anybody done that and what would be the response?

Please respond. i am running short of time as i have to travel back to US soon.

I went for stamping Nov 2006 and mine was also stuck for a week. I don't remember what the rules are now but I just called consulate and talked to some officer (Indian but not VFS). She simply said that they are waiting for security clearance from Washington DC and they won't know when it will clear. I was expecting the worst, may be few months delay but it came after a week. I kept calling during this time. But during that week I was very worried and as a result didn't enjoy the limited vacation :(.

Have to watch this one carefully. Kennedy (one of the co-sponsors of this bill) had thrown EB immigrants under the bus last year while favoring FB and illegals (in CIR). Need to be see the contents of this bill very carefully. Esp this clause from the AILA report:
"Addressing the decades-long backlogs for certain countries by raising the per-country immigration limits from 7 percent to 10 percent of total admission".
The CIR in 2007 had a similar clause, bumping up the country-limit from 7% to 10%, BUT it had another related clause that stopped rollover of visa's in the last quarter.
That would be disastrous for people from India and China as number of visas issued for the whole year will go DOWN!!
The recapture clause sounds promising , provided there is atleast an even split between EB and FB (of EB coming before FB). If they do it the other way around (like they had done in the last recapture for schedule-A nurses) then EB people will see no benefit of the recapture, and will end up losing one more quick-fix option.

Eagerly waiting for the bill text so the dissection and analysis can begin!!

Forum Gurus - I got a denial letter on my 485. I am a July 2007 filer and applied for AOS in July 2007. My 140 was revoked by ex employer in August 2008 and immediately I got a NOID from USCIS and responded to it in a timely manner and my case processing resumed.

But now, I got a denial stating that my 140 has been revoked in August 2008 and thats why my 485 is denied. My Attorney is filing for MTR and says it is a mistake on their side and will be resolved through MTR.

It just baffles me that the person who sent the denial letter never looked into the system to see my case trail and blindly issued the denial notice. My Attorney says, it is very much possible that they do not look at RFEs or responses - they just issue denials when they browse through the 140s.

I am EB2 India with a priority date of March 2006. I think some kind of pre assessment is going on. There are no LUDs and mine is at the TSC.

Is there anyone else in the same boat? How long does it take for MTR to get processed?

ICICI is good at advertising false figures (with our money of course) and SBI is little delayed in updating their websites - does that solves the equation :)

SBI rate is 43.21 for $4001 but i'm sure that's not latest because the website is not updated hour by hour ( like ICICI/R2i/C2i at least do for AD) but I've seen honesty in SBI's dealings when they actually convert $ to Rs. Even if the website shows lower rates they converted my money with higher rates because the market rate was higher during conversion.

They are not gonna update the web site every day....I have asked them about it and the below are the reply from them

We in SBI declare rates as per the market conditions and every day the rates are updated on our site between 10.00am and 11.00am as per IST. excluding saturday and sunday or any bank holidays.
We are transparent about exchange rates and whatever the rates are updated on the site that rate is applicable to all the transaction of that particular date.
Exchange rate is applied when the transaction is processed(i.e 4th - 5th working day after initiation) and not the one when its initiated.The exchange rate appearing on your screen at the time of request is an indicative rate.

Xu1, that is a valid concern. I have sent in this request to admin. But on important issues like this, please do PM admin and other Moderators in addition to public posts. The core group is so drained by all the during the week activities that posts may not be actively monitored during weekends. I think the problem is also logistical, in that we are now getting a lot of checks - which is great, but also now, the core team members handling finances must now take time out to start sending email receipts. So wait for admin and the financial people to get back to you.


Moderators, do you think it's possible to issue an email receipt to contributors? I donated $250 so far and the first $100 was done through my bank billpay.. However, the online billpay deducted the amount right away, and it didn't give me any indication whether the check was actually endorsed by the intended recipient on the supposed delivery date.. Worrying about that, I sent in my second contribution via paypal.

Writing an actual paper check, I would see a copy of endorsement online, or using paypal I would know it's cashed out via email. But this is not the case with my bank's (bank of america) online billpay. Thanks!

maybe we should have a 'sounding board' section where such threads can be started where you can cirb all you want about desi companies/consultants and other issues you want to get out of your system. You do realize that many people read these threads. Spritied discussions are great but upto a certain point and if they help the cause.

We are a small community here and all of us are stuck in a problem we DID NOT create. we are a part of a system that is broken. Instead of crying about problems, lets try and figure out ways to solve one for a change.

if people cannot contribute financially, conrtibute your time and talk to people about IV. Try to meet sucessful/influential immigrants and see if they can help us out, see if they can help us with their contacts. Try to seek people who are stuck in this mess and educate them about it. Get leads on people who can help us out.

Start a thread that mentions what you have done to help IV maybe people will learn from that

H1B problems have nothing to do with retrogression.

If H1B employees are being mistreated by a certain class of employers, then what does that have to do with shortage of visa numbers?

Nothing.

Misuse and abuse of H1B program did not cause retrogression. And if the abuse ends, its not going to end retrogression. The H1B program does provide ammunition to anti-immigrants to use that paint-brush and paint the entire program of H1B and Employment based GC as bad. Fortune 500 companies dont engage in unethical behavior. The TCS, Wipro etc maybe do that. Small bodyshops certainly do that. I am yet to see a small body-shop, operated by a citizen of foriegn origin, working by the book and treating employees well.

But all said and done, these things make our life more difficult and exacerbate the situation that arose from retrogression. However, these things didnt cause retrogression.

At the most, these issues of H1B abuse may have provided support to some groups in keeping the H1B quota down. However, it has nothing to do with EB quota. In fact, IEEE-USA advocates bringing down H1B quota and RAISING the employment based GC quota, in order to remove factors that encourage employer abuse.

These issues are not causes for retrogression, but these issues make it difficult to fix retrogression.

IV moderators and members must not encourage things like "ABC company not paying bench salary for my wife though he took 3k from me to file for h1 and is holding her paystubs etc"" These are the things that will make it difficult to fix retrogression - in these kind of situations it is both employer and employee at fault.

Can you quote the section of the US constitution that prevents discrimination based on "country of origin"?

A lot of people, including me have lost faith in IV. They are not going to pay. We don't know what IV is working on


I believe the core group has made efforts to let us know what they are working on. Obviously, we shouldn't expect them to give us a daily update. That would be quite stupid.


and we don't believe it can do anything. The sooner IV accepts it, the better. I have seen this personally in talking to people and you can see the evidence with less than 300 people contributing. IV needs to produce results first.


I think this has also been addressed here in different threads. IV cannot, just by itself, get congress to pass pro-immigration laws. However, it can influence the senate/congress to add pro-EB provisions to pro-immigration laws.

If you think that with 8000 members, and 300 contributing members, you can have the congress/senate pass pro-EB laws, you are grossly mistaken.


IV needs to figure out other ways to generate cash if it thinks that would help. One way would be advertising on the site. I think IV has built this website well and it is an asset it needs to use NOW. I believe IV can charge up to $10,000 a day for advertising on the website. That would be $300,000/month or $3.6 million a year. Even $3000/day would result in over $1 million. That should not be very difficult to do.

Except, nobody is going to pay 10K/day to advertise on this site.
For a group that can't generate more than 4k-5k per month (200 contributions times 20) for something that it desperately needs, it would be an absolute travesty of common-sense for a business, to invest 300K per month in advertising to such a group.

Keep in mind the following two equations.
Membership+funding+lobbying+patience = Chance of success
Sitting on our butts = Guaranteed failure

BTW, I would also like to point out the antiwar website again.
They are doing a funding drive.

On day 1 of their funding drive, 117 people gave a total of 5312 dollars.
Their goal is 70K for this quarter. And they hope to raise that money in one week. After this week, they will again ask for funding in the next quarter.
Obviously they have a HUGE membership compared to IV. But that just underscores the need for increasing membership.
